Welcome to Kiana Sportswear, LLC (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, products, and services, including custom teamwear orders. By placing an order or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services.

2. Orders & Customization

2.1 Order Placement

All orders must be placed through our official website, authorized representatives, or designated ordering channels. Orders are subject to acceptance and availability.

2.2 Customization Requests

Customers may request the addition of logos, designs, or other personalized elements to teamwear. By submitting such requests, you represent and warrant that you have full legal rights to use and reproduce any provided logos, trademarks, or copyrighted material.

2.3 Production & Delivery

Production timelines and delivery estimates are provided at the time of order confirmation but are subject to change based on availability, supplier constraints, or unforeseen circumstances.

3. Pricing & Payment

3.1 Pricing

Prices are subject to change without notice. Once an order is confirmed, the agreed-upon pricing applies.

3.2 Payment Terms

Orders must be paid in full before production unless otherwise agreed in writing. Late payments may result in delays, cancellation, or additional fees.

3.3 Subscription or Recurring Payments

If you sign up for any subscription-based service, you will receive clear renewal terms and the ability to cancel at any time. In compliance with California’s Auto-Renewal Law (Cal. Bus. & Prof. Code § 17600 et seq.), you will receive a reminder notice before renewal, and cancellation will be available through an easy, accessible method.

4. Returns, Exchanges & Refunds

4.1 Custom Orders

Due to the personalized nature of teamwear, custom orders are non-refundable and non-exchangeable unless there is a manufacturing defect.

4.2 Defective or Incorrect Orders

If you receive defective or incorrect items, you must notify us within 15 days of receipt. We will assess the issue and determine the appropriate resolution, which may include a replacement or partial refund.

4.3 Kiana Fit Guarantee

If the size you ordered is incorrect, you are eligible for a one-time exchange to another size at no additional cost. This guarantee does not apply to team orders and is subject to size availability. To qualify, the item must be returned in unworn condition with tags attached within 15 days of receipt.

5. Intellectual Property & Indemnification

5.1 Our Intellectual Property

All designs, branding, and original content on our website and products remain the exclusive property of Kiana Sportswear, LLC. Unauthorized use, reproduction, or distribution is strictly prohibited.

5.2 Customer-Provided Logos & Content

If you submit logos, trademarks, or other design elements for inclusion on custom teamwear, you represent and warrant that you have the legal right to use them.

5.3 Indemnification

You agree to indemnify, defend, and hold harmless Kiana Sportswear, LLC, its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from any alleged or actual trademark infringement or unauthorized use of third-party intellectual property related to logos, trademarks, or designs you provide for customization. The risk and responsibility for ensuring proper authorization rest entirely with you.

7. Limitation of Liability

To the fullest extent permitted by law, Kiana Sportswear, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or services. Our total liability shall not exceed the amount paid for the specific order in question.

8. Governing Law & Dispute Resolution

These Terms are governed by the laws of California. Any disputes shall first be attempted to be resolved through mediation. If mediation is unsuccessful, disputes shall be resolved exclusively in the courts of California.
